This page sets out the terms and conditions for your use of the New Zealand Motor Caravan Association Incorporated (referred to throughout these terms and conditions as NZMCA, we, us or our) website, app and social media (referred to throughout these terms and conditions as digital media). By using our digital media, you are agreeing to comply with these terms and conditions, which together with our Privacy Policy govern NZMCA’s relationship with you in relation to the digital media.

Your rights and obligations

NZMCA grants you permission to access and use information on our digital media for personal or in-house use. For any other use or dissemination of the information on NZMCA’s digital media, you must contact NZMCA in writing for permission at [email protected] or PO Box 72147, Papakura 2244.

Your use of any of the information on our digital media is entirely at your own risk. It will be your responsibility to ensure that such information meets your requirements. 

You will not use any unauthorised means, automated or not, to damage or attempt to damage our digital media, underlying networks or data storage. You will not introduce code or other matter that does or is intended to harm, disable, disable, destroy or adversely affect the digital media, any of NZMCA’s technology, network, systems or data. Unauthorised use of our digital media may give rise to a claim of damages and/or be a criminal offence. 

Our Intellectual Property

All intellectual property on our digital media including (without limitation) the text, graphics, copyright works and and trade mark, is owned by us (or by third party content suppliers). We are the exclusive owner of all rights in the compilation, design and layout of our digital media. 

Limitation of Liability 

NZMCA provides the material on our digital media in good faith. The information is derived from sources believed to be accurate and current. Its use on our digital media does not imply endorsement, nor does it guarantee the accuracy of the information. To the fullest extent permitted by law: 

• Neither of the NZMCA, its governing body or any of its employees or other personnel give any representations,  warranties, and guarantees (whether express, implied or statutory), including (without limitation) as to the completeness, accuracy, timeliness, performance, or suitability of our digital media or the information and materials found on, or offered through, it for any particular purpose. 
• We will not be liable for any damage, loss, expense or indirect losses of any consequential damages of any kind, suffered or incurred by you in connection with your access to, or use of our digital media or the content on or accessed through it.

If the Consumer Guarantees Act 1993 (CGA) applies, you may have rights or remedies which are not excluded nor limited by the above. If you are in trade and using our digital media or its content for business purposes, you agree that the above exclusions and limits will apply and the CGA will not apply. 

From time to time, our digital media may include links to other third party websites and sources. These websites have not been developed by us and are not controlled by us. We have no responsibility for the content of these third party websites and sources. The links within our digital media are provided for your convenience only. They do not imply that we verify, endorse, approve or agree with such third party websites or sources. Third party websites or sources will likely have their own restrictions on how you may use their content and what responsibility the third party will accept in relation to the content. You should ensure you read and comply with any terms and conditions that apply to those websites or sources.

Views and opinions expressed in the comments sections of our digital media (on the Travel Directory or Motor Caravanner) are the views and opinions of the member submitter (as identified on the comment), and do not represent the views or opinions of the NZMCA. 

Privacy

All personal information collected on the NZMCA website will be handled with in accordance with the Privacy Act 2020 and NZMCA’s Privacy Policy. 

User Content

If you contribute content to be made available on our digital media, including but not limited to, text, photo(s), image(s), video(s), document(s), recording(s), comment(s), data or any other material (User Content):

• you will continue to be the owner of the User Content and have the right to use the User Content you provide NZMCA; and  
• you grant to us a non-exclusive, transferrable, sub-licensable, royalty-free and worldwide licence to host, use, copy, distribute, modify, run, publically perform or display, translate, and create derivative works of your User Content including, without limit, on our digital media, any other digital media controlled by us or platform or any publication we may make from time to time .

By contributing User Content you warrant to NZMCA that: 

• you are the owner of the User Content, or you have the right to provide the User Content to us; 
• providing the User Content to us does not breach any intellectual property, privacy or confidentiality rights of any person or entity; 
• the User Content does not  impersonate, or otherwise purport to be provided by other person or organisation; 
• the User Content does not include private information of any third party, including (but not limited to), surname (family name), addresses, phone numbers, email addresses or credit card numbers; 
• the User Content is not false, or misleading; 
• the User Content is not illegal, harassing and does not advocate harassment of another person, threatening, obscene, offensive, pornographic, indecent, lewd, suggestive, discriminatory or defamatory, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable or which discriminates against or vilifies any group or individual. 

If you allow us to use content from your own website, we will do so in line with your terms and conditions of use.

Moderation

We are a community-based organisation and strive for high standards of interaction with and between members. We endeavour to maintain a safe, honest and positive environment and therefore, we reserve the right to, in our sole discretion and for any reason, pre-screen, review, flag, filter, modify, refuse, remove, moderate and not publish any User Content you provide. We also reserve the right to disable a members ability to contribute User Content if a member repeatedly breaches these terms & conditions.

Changes to the terms

NZMCA may change our digital media or these terms at any time. In using our digital media you are bound by any new terms.

Governing Law 

Your use of our digital media and any dispute arising out of such use of our digital media is subject to the laws of New Zealand and will be dealt with by the New Zealand courts, and you agree to submit to the jurisdiction of the New Zealand courts.
